1. Agreement to these terms
These terms apply to your use of this website and to the services provided by Around29 Digital Media Solutions, LLC (“Around29”, “we”, “us”). By using the site or our services, you agree to these terms. If you have a signed agreement, proposal or statement of work with us, that document takes priority where it differs from these terms.
2. Using our website
You agree to use the site lawfully and not to interfere with it, attempt to access it without permission, or copy its content for commercial use without our written consent. Free audits, reports and tools on the site are provided for general information and are not a guarantee of results.
3. Our services
The scope, deliverables, timelines and pricing for our services are set out in your proposal, invoice or agreement. We will perform the services with reasonable skill and care. Search engines, AI assistants and ad platforms control their own rankings, placements and policies, so we cannot guarantee specific rankings, traffic, mentions or ad results.
4. Your responsibilities
- Give us accurate information and the access we need, such as website, ad account and Google Business Profile access
- Review and approve content and campaigns in a reasonable time
- Make sure the materials you give us (logos, photos, text) are yours to use
- Keep your own accounts and passwords secure
5. Payment
You agree to pay for services according to the pricing and payment terms in your proposal, invoice or agreement. Advertising spend paid to platforms such as Google or Meta is separate from our fees unless your agreement says otherwise. We may pause or stop services if invoices remain unpaid after their due date.
6. Text messages and email
By giving us your phone number or email address and agreeing to be contacted, you agree to receive messages about your inquiry and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help, and use the unsubscribe link to stop marketing emails. See our Privacy Policy for details.
7. Intellectual property
The content, design and code of this website belong to Around29 or its licensors. Work we create for you becomes yours as set out in your agreement once it has been paid for in full. Our in-house tools, including Search29, Send29, Reach29 and Mail29, remain our property; your use of them is covered by their own terms.
8. Limitation of liability
To the fullest extent allowed by law, Around29 is not liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to our services is limited to the amount you paid us for the specific services giving rise to the claim during the three months before the claim.
9. Ending services
Either party may end services as set out in your agreement. We may suspend access to the site or our services if these terms are breached.
10. Governing law
These terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Maryland, unless your agreement with us says otherwise.
11. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top shows when they last changed. Continuing to use the site or our services after a change means you accept the updated terms.
